Verdict Returned in Medical Malpractice Case

A Stephens County jury finds a doctor not guilty of medical malpractice.

Friday afternoon, a jury found in favor of defendants Dr. Gordon M. Kelly and Toccoa Clinic Medical Associates, LLC in a medical malpractice trial that took place in Toccoa last week and did not award any damages to plaintiffs Sallie and Willie Grant.

Mr. and Mrs. Grant had filed a civil suit against Dr. Kelly and the Toccoa Clinic Medical Associates in connection to a medical procedure that took place in 2011.

According to suit filed by the Grants, they said Dr. Kelly caused permanent liver damage to Mrs. Grant as a result of a procedure to remove her gall bladder.

The Grants accused the defendants of negligence and carelessness and alleged that they failed to follow the standards of medical practice and exercise reasonable skill.

Information on file with the Clerk of Court’s Office indicates that the Grants were each seeking an unspecified amount of monetary damages in excess of $10,000.

The trial took the entire week in Stephens County Superior Court, as jury selection started on Monday and the not guilty verdict in favor of the defendants came on Friday afternoon.
